How the Massachusetts Real Estate Broker Bond Works
Massachusetts General Laws c. 112, § 87TT requires the bond to be payable to the Commonwealth for the benefit of any person aggrieved. The bond is conditioned on the faithful accounting by the broker for all funds entrusted to the broker in that capacity. Aggregate surety liability cannot exceed the $5,000 penal sum.
The bond involves three parties:
Principal: Massachusetts real estate broker
Obligee: Commonwealth of Massachusetts
Surety: Surety company authorized to do business in Massachusetts
